§ 1

GENERAL INFORMATION:

1. These Terms and Conditions, hereinafter referred to as the “Terms and Conditions,” define the detailed rules for using the services provided at the LA GIO CONTOUR MAŁGORZATA WIŚNIEWSKA salon located at ul. Warszawska 181E/3, hereinafter referred to as the “Salon.”
2. The Salon provides services Monday through Friday from 9:00 AM to 5:00 PM.
3. Treatments are performed only during Salon opening hours.
4. LA GIO CONTOUR reserves the right to change opening hours. A change may result in the temporary closure of the Salon, as well as shortening or extending its opening hours due to the urgent need for repairs, maintenance, or other necessary work.
5. Clients of the Salon are required to read the Terms and Conditions before booking an appointment for Services at the Salon. Joining a selected Service constitutes acceptance of these Terms and Conditions, without the Client having to sign them. 6. The Terms and Conditions, together with the Price List and Service Description, constitute a contract for the provision of Services and are the primary document governing the cooperation between LA GIO CONTOUR Salon and its Clients, ensuring the highest quality of permanent makeup services provided at the Salon.
7. The purpose of my business is to perform permanent makeup services in accordance with applicable law, available methods, and disease prevention measures, with due diligence, and in accordance with the principles of professional ethics.
8. LA GIO CONTOUR operates in accordance with these Internal Regulations, developed based on the following legal acts:
1. Civil Code;
2. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR); 3. The Personal Data Protection Act of May 10, 2018 (Journal of Laws of 2018, item 1000);
4. The Regulation of the Minister of Internal Affairs and Administration of April 29, 2004, on personal data processing documentation and the technical and organizational conditions to be met by devices and IT systems used for personal data processing (Journal of Laws No. 100, item 1024).
5. The Consumer Rights Act.

§ 2

DEFINITIONS

1. Customer – means a natural person, of legal age, who is at least 18 years of age and has full legal capacity.
2. Minor – means a Customer who is under 18 years of age and uses the Salon Services with the oral or written consent of a parent/legal guardian.
3. Terms and Conditions – means these Terms and Conditions prepared by the Service Provider. 4. Salon – means the Service Provider providing Services at a given location at the address provided.
5. Service – means the service/treatment provided by the Service Provider to the Client.
6. Reservation Deposit – a form of security for booking an appointment on a given date, payable in advance before the Service is performed and deducted from the final price after the Service is performed.

§ 3

CUSTOMER OBLIGATIONS

1. A client of the Salon is an adult or a minor with the consent of a legal guardian. In the case of a minor, the Salon is entitled to review the relevant consent of the legal guardian before the visit and to refuse to provide the Service in the absence of such consent.
2. The Client is required to provide information about their health if necessary to make a decision about performing a specific Service and to sign a declaration of the accuracy of the information provided by completing and signing the required documentation. LA GIO CONTOUR services are available after the Client has been qualified for the procedure, completed the forms, including the client’s card, medical history, consent to the procedure, and photographic documentation.
3. Each Client is familiarized with the indications, contraindications, side effects, and post-treatment recommendations. Before beginning the Treatment, the Client is fully aware of and accepts them. This is confirmed by the Client’s signed informed consent to the procedure. 4. In the event of health problems that constitute a relative contraindication to the treatments offered at LA GIO CONTOUR, consent from the treating physician must be provided.
5. The Client uses treatments at their own risk and may not submit any claims to LA GIO CONTOUR for bodily injury or loss of health, unless the Salon caused this through negligence.
6. Each time a treatment is repeated, the Client must confirm the validity of their health condition and the information provided, or update their medical information, particularly any contraindications.
7. The Client is obligated to immediately notify the person performing the treatment if their health condition deteriorates during the Service.
8. Clients should arrive for their scheduled appointment without any accompanying persons.
9. The Client is obligated to arrive on time for their scheduled appointment or at least 5 minutes before the scheduled Service.
The Client should notify the Salon of any potential delays by telephone in advance. 10. The Salon allows the Client to be late for a maximum of 15 minutes; after this time, the Service will be canceled or shortened. Each case of delay will be considered individually by the Salon.
11. If the Client persistently cancels appointments later than permitted by these Terms and Conditions, or fails to show up for an appointment without canceling it on the specified date more than twice, the Salon reserves the right to refuse to provide the service or to book another appointment for the Client.
12. Inappropriate behavior by the Client on LA GIO CONTOUR premises or gross violations of order or the course of the services provided will result in the refusal or termination of the Service and an immediate request to leave LA GIO CONTOUR.
13. The previously agreed upon time of arrival at the Salon is approximate due to the nature of the services provided and the emphasis on their highest quality and professionalism.
14. Each Client undergoing the treatment declares that they have read these Terms and Conditions. 15. LA GIO CONTOUR reserves the right to modify the provisions of these Terms and Conditions, which will be available on the website www.lagiocontour.com.
16. In matters not regulated by these Terms and Conditions, the relevant provisions of the Civil Code shall apply.

§ 4

SALON OBLIGATIONS

1. Before performing a Service, the Salon is obligated to:

– interview the Client regarding their expectations and health status, and collect a completed and signed Client Card/consent to the procedure from the Client,
– present the Client with any contraindications to the Service and any post-Service recommendations,
– inform the Client about the actual effects of the procedure, the number of treatments needed to achieve the intended effect, any side effects or complications after the procedure, and the preparations used for the procedure,
– adhere to hygiene and safety rules during the performance of the Service in accordance with sanitary procedures,
– take photos before and after the procedure for treatment documentation.

2. The Salon reserves the right to amend these Terms and Conditions for important reasons, such as: changes in legal regulations, changes in payment methods, or changes in the provision of Services – to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The new Terms and Conditions will take effect on the date of the amendments. The Salon undertakes to inform all Clients with booked appointments of any changes to the Terms and Conditions before performing the Services.

3. If there are any doubts regarding the safety of the treatment, the Salon reserves the right to refuse the procedure.

§ 5

PRICE LIST

1. The Salon provides the Services listed in the current Price List, available at the Salon’s reception desk and on the website www.lagiocontour.com.
2. Before selecting a Service, the Client may review its description, duration, and price.
LA GIO CONTOUR reserves the right to make changes to the company’s offer and price list. The current offer is posted on this website. Treatments are performed according to the Price List in effect on the date of the Service. All prices listed in the Price List and on the website www.lagiocontour.com are gross prices and are expressed in Polish zloty.
Discounts, discounts, and promotions cannot be combined.

§ 6

APPOINTMENT BOOKING RULES

1. The Salon accepts appointments and bookings through: Registration – IN PERSON OR BY PHONE: +48 570 532 358
2. The Client is required to provide their current contact information when making an appointment.
3. LA GIO CONTOUR Salon reserves the right to process contact information to confirm, reschedule, or cancel an appointment by phone, text message, or, in some cases, email.
4. The Client will receive a text message reminder from the Salon 48 hours before their appointment.
5. For Services, the Salon requires a PLN 200 prepayment from the Client within 3 business days of booking.
6. The Client can pay the reservation deposit in person at the Salon or by bank transfer to the account number provided by the Salon. Bank transfer account number:

7. If the Client cancels the appointment less than 48 hours before the Service or does not show up without notice, the deposit will be non-refundable (except in the case of illness).
8. The deposit is non-refundable if the Salon is not informed of the change of appointment. LA GIO CONTOUR reserves the right to charge a prepayment due to cases of irresponsible bookings and no-shows, which significantly disrupts the salon’s operations.
9. Appointments can be changed or canceled without losing the prepayment up to 48 hours before the scheduled appointment. After this time, the reservation deposit is non-refundable – it is compensation for the reserved time, which, if not canceled, will be held for another client.
10. Unconfirmed reservations within 3 days will be canceled.
11. Clients who have booked an appointment are required to arrive on time or no later than 5 minutes before the agreed-upon time. If the client is less than 15 minutes late, the delay will be deducted from the scheduled treatment time.
In the event of a delay exceeding 15 minutes, LA GIO CONTOUR reserves the right to refuse the procedure, schedule a different time, or schedule a different date. Delays exceeding 15 minutes may result in the salon being unable to perform the service according to established standards. This will result in the loss of the prepayment, as the treatment cannot be performed due to the delay.
12. If the client fails to cancel the appointment or repeatedly cancels, I reserve the right to refuse re-registration due to disruption in my workflow. 13. If the Client repeatedly cancels appointments later than specified in these Terms and Conditions, or fails to show up for an appointment without canceling on the specified date more than twice, I reserve the right to refuse to provide services or book another appointment. Unforeseen circumstances will be considered individually.
14. If the appointment is rescheduled twice, I reserve the right to charge a reservation deposit of the full treatment fee to the new date.
15. If the Salon cancels a Service or changes the Service date to a date that is not convenient for the Client, the reservation deposit will be refunded in full via bank transfer to the details provided by the Client within 14 calendar days.
16. If the Service is performed, the prepayment will be applied to the price of the Service provided to the Client. The final price settled after the Service is performed will be reduced by the amount of the prepayment.
17. For the purposes of these Terms and Conditions, “Force Majeure” means any event beyond the Salon’s control, including, but not limited to, Force Majeure may exclude any force majeure event, epidemic or pandemic, war, uprising, civil unrest, riots, acts of terrorism, fire, explosion, flood, theft or failure of essential equipment, intentional damage affecting the operation of the Salon, strike, lockdown, weather conditions, acts and regulations of state or local government authorities, or sudden utility shutdowns in the Salon. The Salon will not be liable to the Client for failure to fulfill any obligations under these Terms and Conditions to the extent caused by an event of Force Majeure. In such a situation, the Client will be given the option of: reserving another available date or receiving a refund of the deposit. 18 LA GIO CONTOUR reserves the right to change the dates or times of appointments, consultations, and treatments, or cancel them in justified cases.

§ 7

HYGIENE AND SAFETY – SALON STANDARDS

1. The owner of LA GIO CONTOUR, MAŁGORZATA WIŚNIEWSKA, declares that she is appropriately trained and experienced, holds current health examinations, and performs Services to the highest standard and with due diligence.
2. Before commencing the Service, Małgorzata Wiśniewska is obligated to properly prepare her workstation and ensure proper disinfection before each Client. She is obligated to perform the treatment correctly in accordance with applicable procedures and professional practice, while maintaining appropriate hygiene and sanitary conditions, as well as occupational health and safety and fire protection regulations.
3. Only disposable applicators and disinfected accessories and tools are used in the Salon.
4. In the event of a Client’s cut or injury, appropriate dressing and disinfection procedures are applied, consistent with first aid principles. 5. At LA GIO CONTOUR, I maintain the highest safety standards, but I am not responsible for any items left in the salon.
6. LA GIO CONTOUR reserves the right to refuse to perform a treatment to a client whose condition indicates the consumption of alcohol or drugs.

§ 8
TREATMENT RULES

1. Consent to a treatment may be given by an adult client with full or limited legal capacity. 2. By proceeding with the procedure, the Client automatically declares that:
– they are aware of the purpose and possible effects of the procedure,
– all issues related, directly or indirectly, to the preparation for and application of the selected procedure have been explained to them and are fully understood,
– they are aware of and understand all contraindications, possible side effects, and effects of the procedure,
– they have been informed of the characteristics of the selected Services, understood that they are performed with due diligence, and are aware that the procedures in question do not guarantee the achievement of certain and visible results,
– before proceeding with the Permanent Makeup Service, the Client has considered their health condition and will not proceed with it if, due to this condition, it could have a negative impact on their life, health, mental or physical well-being,
– they are not pregnant, postpartum, or breastfeeding,
– they are not taking medications, taking other substances, or having any medical conditions that are a contraindication to the Permanent Makeup Service,
– they have made a conscious decision to choose the most appropriate procedure, taking into account his/her current health condition and available technical resources,
– consents to modifying the method of performing the Permanent Makeup Service or even withdrawing it if continuing it in accordance with the prescribed procedure would endanger his/her life or health.

§ 9

DOCUMENTATION

1. LA GIO CONTOUR reserves the right to refuse to perform a Service without the Client having completed and signed the documents necessary for its performance, or if the Client refuses to provide photographic documentation.
2. The Client is solely responsible for the accuracy and veracity of the information provided in all documents.
3. For personal data protection reasons, for the purposes listed below, the Client must complete the appropriate applications for:
a) access to medical records;
b) an extract from the appointment system;
c) access to past appointments/access to photographic documentation;
d) issuance of photographic documentation;
e) sending an invoice for the completed visit;
f) authorization for a third party to collect the documentation indicated by the Client.
4. Rules for providing Client documentation:

* Client documentation is the property of LA GIO CONTOUR. * The Client has the right to access documentation regarding the services provided to them based on submitted applications:
a) to inspect medical and photographic documentation directly at the facility
b) to issue medical and photographic documentation, copies, or extracts thereof.

5. LA GIO CONTOUR provides medical and photographic documentation;

a) to the Client or their legal representative, or a person authorized in writing by the Client based on a submitted application;
b) to entities authorized to access the Client’s medical and photographic documentation under applicable law.

§ 10

PAYMENTS

1. Payment for Services offered by LA GIO CONTOUR is possible by cash, BLIK, or gift voucher.
2. Payment for Services offered by LA GIO CONTOUR is made after the Service (consultation, procedure) is completed. The reservation deposit prior to the Services is an exception.
3. After payment, the Client receives a receipt or invoice. 4. If the Patient is unable to pay for the Service provided, they are required to complete a payment declaration and pay it within 3 business days. In the absence of such a declaration, LA GIO CONTOUR reserves the right to send a written request for payment. Failure to pay within the specified timeframe will result in legal action.

§ 11

COMPLAINTS

1. The Client has the right to submit a complaint regarding the Service within 42 days of its completion or the occurrence of undesirable post-treatment effects.
2. To file a complaint, proof of service performance at the Salon must be provided, e.g., through a receipt or a confirmed reservation.
3. The Client should submit a complaint in writing to lagiocontour@gmail.com or in person at the Salon.
4. The complaint must include the Client’s personal data enabling their identification and contact information, a description of the reason for the complaint, including the scope of the requests, and photographic and/or video documentation of the complaint.
5. In all cases, the condition for consideration of the complaint is that the Client appears in person at the Salon within 48 hours of submitting the complaint for an assessment necessary to resolve the complaint.
6. The Service Provider will consider the complaint within 14 days of its receipt and will inform the Client in writing or by email using the contact details provided. 7. After the complaint has been reviewed, the Client is required to sign a complaint protocol.

§ 12

REGULATIONS FOR USE OF GIFT VOUCHERS/LA GIO CONTOUR VOUCHER

1. Only adults may use a gift voucher.
2. Minors may redeem a gift voucher only with prior written consent from their legal guardian.
3. A gift voucher is a paper document enabling payment for services provided at LA GIO CONTOUR.
4. A gift voucher can be purchased at a LA GIO CONTOUR Salon.
5. The voucher will be shipped to the address provided by the buyer after the specified amount has been credited to LA GIO CONTOUR’s bank account. A gift voucher is issued:
– for a treatment selected by the purchaser,
– for a specific amount equivalent to the payment made for the voucher, which can be redeemed for any treatment or product offered by LA GIO CONTOUR.
6. The gift voucher is only redeemable by the person named on the voucher.
7. The gift voucher holder may not modify the information on the voucher in any way.
8. To redeem the voucher, an appointment with LA GIO CONTOUR must be booked in advance.
9. The voucher is valid for 6 months from the date of issue and has a unique number.
10. In justified cases, LA GIO CONTOUR may extend the validity of an issued voucher only after prior written notification from the voucher holder at least 7 days before its expiry date.
11. In other cases, after the expiry date, the purchased gift voucher is considered invalid. 12. To use a gift certificate/voucher, you must present it before using the services.
13. In the event of a discrepancy between the name of the person indicated on the voucher and the name of the person wishing to use it, LA GIO CONTOUR reserves the right to refuse the voucher and cancel it.
LA GIO CONTOUR reserves the right to modify the Terms and Conditions for the Use of Gift Certificates/Vouchers, provided that the changes made do not violate the rights acquired by Customers during the offer period. Any changes to these Terms and Conditions will be available from time to time on the website www.lagiocontour.com.

In matters not regulated by these Terms and Conditions, the provisions of the LA GIO CONTOUR Terms and Conditions or the relevant provisions of the Civil Code shall apply.

§ 13

PROCESSING OF CUSTOMERS’ PERSONAL DATA

1. By booking an appointment at the Salon, the Client consents to the processing of their personal data for the purposes described below in this paragraph.

4. Clients’ personal data obtained in connection with the use of the Salon Services will be processed for the following purposes: to communicate with the Client (receiving information about planned appointments via mobile phone and email) and to perform the Service. 5. The legal basis for processing Customer data will be: consent, necessity for the performance of a contract or to take action at the Customer’s request prior to entering into a contract, necessity to comply with a legal obligation incumbent on the controller, necessity for purposes arising from legitimate interests pursued by the controller, e.g., responding to Customer letters and requests.
6. Customer data may be transferred to the following entities: processors (processors) in connection with activities commissioned by the Salon, entities authorized under law, control and supervisory entities, enforcement authorities, courier companies that will deliver parcels to Customers. Customer data will be transferred to a third country (e.g., the USA) in connection with activities conducted on Facebook (customers contacting the Salon’s Facebook or Instagram fanpage).
7. The period of processing Customer personal data depends on the purpose for which the data is processed. The period for which personal data will be stored is calculated based on the following criteria: legal provisions that may oblige the Salon to process data for a specific period (e.g., we store invoice data for 5 years from the end of the last fiscal year), the period necessary to defend the Salon’s interests, and the period for which consent was granted.
8. Furthermore, I inform you that Customers have the right to: request access to their personal data, rectify their data, request the completion of incomplete personal data, including by providing an additional declaration, delete their data or restrict its processing, object to the further processing of their personal data, and transfer their personal data. However, in exceptional circumstances, data cannot be deleted immediately. These include:
– data necessary to provide the Service and any complaints period,
– data for which there are legal grounds to continue processing,
– data processed in accordance with other legal provisions.
9. Customers have the right to withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of data processing based on consent granted prior to its withdrawal.
10. If in doubt about the correctness of personal data processing by the Salon, Clients have the right to lodge a complaint with a supervisory authority. All correspondence regarding personal data processing should be directed to the Administrator’s address with the subject line “Personal Data” at the following email address: lagiocontour@gmail.com. Clients’ personal data are processed in accordance with the above-mentioned content and for the purposes indicated in the aforementioned information clause, which the Client also reads during their first visit to the Salon.

§ 14

FINAL PROVISIONS

1. Each Client has the right to review the Terms and Conditions, Price List, and Certificates to which the Service Provider refers regarding their own experience.
2. The current Salon Terms and Conditions are posted and available in the Salon in a visible and accessible place for Clients.
3. Clients are liable without limitation for any damage to Salon equipment caused by Clients in accordance with Article 415 of the Civil Code. Their legal representatives are liable for any damage caused by minors.
4. The Salon is not liable for any items left in outerwear or in the Salon outside of designated areas, in particular valuables, bags, backpacks, and purses, which the Client should keep with them. 5. Smoking and the use of tobacco, tobacco and nicotine products, including electronic cigarettes, are strictly prohibited throughout the Salon. Consumption of alcoholic beverages and other stimulants and intoxicants is also strictly prohibited.
During the Service, the Customer is prohibited from using the telephone, except in emergencies.

Animals are prohibited from entering the Salon.

Any disputes arising from the Services provided should be resolved amicably in the first instance. In the event of failure to reach an agreement, disputes will be resolved by a court of general jurisdiction.

If any provision of these Terms and Conditions is deemed invalid, unlawful, or unenforceable, it will be excluded from these Terms and Conditions, which will continue to apply to the fullest extent permitted by law.
